About Financial Crimes Legal:

The Financial Crime Legal team advises the business, functions (e.g., legal, compliance, risk audit), and senior management on financial crime laws and regulations, and how they impact our business and controls. The team globally, provides timely, high quality and commercially focused legal and regulatory advice on complex anti-money laundering (AML), counter-terrorist financing (CTF), financial sanctions, and anti-bribery and corruption (ABC) matters. 

  • Provide support to business and their transactions in relation to financial crime matters.
  • Provide expertise and leadership for significant investigations involving AML/CTF, Sanctions and ABC. 
  • Lead policy efforts for significant AML/CTF, Sanctions and ABC issues.

Interact with key Government stakeholders and law enforcement on AML/CTF, Sanctions and ABC issues

Overall purpose of role

  • To be the primary regional contact for all business lines in relation to sanctions matters, taking the lead on providing timely, expert, pro-active legal advice in this area. 
  • To take a leading role on policy efforts internally and externally in the sanctions arena for the region.
  • Attend relevant governance fora for the region, across all business lines, where sanctions considerations are at the heart of an issue, for example, Transaction Review Committees.
  • To lead on complex financial crime issues arising within CIB, in particular, those with a sanctions nexus.
  • To provide strategic leadership on legal issues relating to sanctions, working with other functions to improve the efficiency and effectiveness of sanctions risk management within the region and across the Bank, providing an effective oversight of and credible challenge on sanctions issues.
  • To provide legal support to the Business MLROs and financial crime compliance teams within the region.
  • To deliver functionally excellent legal advice in relation to sanctions matters, and where required, advise on ABC, AML and CTF issues.
  • To collaborate with Financial Crime Compliance (Sanctions, ABC, AML, FIU and the MLROs), Compliance (including Regulatory Compliance), Legal (particularly Product Legal and Litigation, Investigations & Enforcement), Audit, regional management and the businesses to ensure the delivery of an improved risk management strategy, including supporting financial crime projects, policy revisions and implementation. 
  • To proactively seek to identify unmanaged risk and emerging trends in financial crime, (including forthcoming laws, rules and regulations) and help deliver legal advice on procedures and controls of to anticipate those trends and deliver sustainable value within the region and to the Bank globally.
  • To collaborate with Litigation, Investigations & Enforcement and Financial Crime Compliance in the execution and management of investigations and enforcement actions relating to financial crime issues.
  • Where necessary, provide additional support on matters handled by the Financial Crime Legal team, globally.  
  • Instruct and manage external counsel as required.

Key Responsibilities

  • Support and advise regional management team and senior management in relation to financial crime issues, in particular sanctions, in line with the role description above. 
  • Support the provision of strategic oversight and direction in support of Financial Crime Compliance projects, policy preparation and implementation, in particular, in relation to sanctions.
  • Engage and support engagement with key regulators in the region on ongoing and emerging developments in sanctions.  
  • Partner with the Litigation, Investigations & Enforcement, Intelligence Development and Investigations in the execution and management of investigations and enforcement actions.
  • Assist with the development and implementation of governance and reporting across the Financial Crime Legal team, including the provision of periodic Management Information.
  • Help prepare and participate in the delivery of key briefings and training programmes to senior management, key business stakeholders, and wider legal and compliance teams, especially on emerging sanctions developments.   
  • Actively participate in Financial Crime Legal team activities and development opportunities.

Person Specification

  • Qualified lawyer (Solicitor, Barrister, Attorney or equivalent). 

  • Strong analytical skills to advise on financial crime legal issues.

  • Experience in advising on UK/EU sanctions matters. 

  • Problem solving skills, focusing on collaboration and pragmatic approach to advising on solutions to complex financial crime issues.

  • Effective interpersonal skills. Clear and concise written and oral communication, including ability to distill legal concepts into common sense language. 

  • Ability to develop networks across the organisation and develop strong relationships with key stakeholders, as well as influence and maintain credibility with stakeholders.  

  • Strong negotiation skills.

  • Ability to develop understanding of commercial ‘bigger picture’ in which the legal team provides financial crime legal advice.

  • Willingness to identify emerging issues including when they cut across other areas of law.

  • Ability to take ownership of matters, and be accountable for high quality output.  

Essential Skills

  • In depth knowledge of UK financial crime law, particularly in relation to sanctions.

Purpose of the role

To ensure that the institution’s activities are conducted in compliance with applicable financial crime laws and regulations, and to help the bank manage legal and reputational risks associated with its activities. 

Accountabilities

  • Development and implementation of best practice legal strategies for risk management and compliance.
  • Legal advice and support to the business on financial crime laws, regulations, and rules, including anti-money laundering (AML), sanctions, and anti-bribery and corruption (ABC) laws and regulations.
  • Support other legal teams in representation, of the bank in legal proceedings that raise financial crime issues, such as litigation, arbitration, and regulatory investigations.
  • Advising on financial crime compliance policies and procedures including to assess compliance with applicable laws and regulations.
  • Legal research and analysis to stay up to date on changes in laws and regulations that may impact the bank's financial crime compliance practices.
  • To support Compliance, contributing to and delivering training to educate employees on legal and regulatory requirements related to financial crime.
  • Pro-active identification, communication, and provision of legal advice on applicable laws, rules and regulations (LRRs). Keeping up to date with regards to changes to LRRs in the relevant coverage area. Ensuring that LRRs are effectively allocated to, and adequately reflected within, the relevant policies, standards and controls.

Or for an individual contributor, they lead organisation wide projects and act as deep technical expert and thought leader, identifying new ways of working and collaborating cross functionally. They will train, guide and coach less experienced specialists and provide information affecting long term profits, organisational risks and strategic decisions..
  • Provide expert advice to senior functional management and committees to influence decisions made outside of own function, offering significant input to function wide strategic initiatives.
  • Manage, coordinate and enable resourcing, budgeting and policy creation for a significant sub-function.
  • Escalates breaches of policies / procedure appropriately.
  • Foster and guide compliance, ensure regulations are observed that relevant processes in place to facilitate adherence.
  • Focus on the external environment, regulators, or advocacy groups to both monitor and influence on behalf of Barclays, when appropriate.
  • Demonstrate extensive knowledge of how the function integrates with the business division / Group to achieve the overall business objectives.
  • Maintain broad and comprehensive knowledge of industry theories and practices within own discipline alongside up-to-date relevant sector / functional knowledge, and insight into external market developments / initiatives.
  • Use interpretative thinking and advanced analytical skills to solve problems and design solutions in often complex/ sensitive situations.
  • Exercise management authority to make significant decisions and certain strategic decisions or recommendations within own area.
  • Negotiate with and influence stakeholders at a senior level both internally and externally.
  • Act as principal contact point for key clients and counterparts in other functions/ businesses divisions.
  • Mandated as a spokesperson for the function and business division.
