About Global Contract Services (GCS):   
GCS is a global team within Markets Legal that is primarily responsible for the negotiation and execution of master trading documentation for Barclays’ client-facing Markets business.

The role holder will be responsible for leading a team of legal professionals in EME for the negotiation and execution of master trading documentation for Barclays’ client-facing Markets business. The role holder will play an active role in a multi-year transformation of people, processes and technology in furtherance of the GCS mandate. The role holder will work in close collaboration with the Head of GCS, Markets front office personnel and other stakeholders within and outside of Legal and across regions to support the Markets business’ client-facing objectives.

Key Accountabilities

  • Possess subject matter expertise in Markets products and ability to draft and negotiate related master trading documentation for OTC derivatives, repo, reverse repo, securities lending, prime brokerage, and futures and options clearing and execution as well as related collateral documentation.
  • Lead a team of legal professionals whose focus, skills, and development are trained on understanding and supporting the Markets business' wholesale product offerings and wholesale client engagement.
  • Serve as a partner and trusted advisor to senior Markets business leaders in order to understand the business' priorities, identify and manage legal risk, and deliver legal work product accordingly.
  • Operate with speed, pragmatism, and flexibility, especially in the context of the Markets business' areas of strategic growth.
  • Understand and implement regulatory change relevant to the Markets business
  • Understand multijurisdictional netting and collateral legal opinions and overlay them on the Markets business, including through engagement with Risk and Capital partners to ensure that legal documentation effectively feeds related downstream infrastructure for balance sheet and risk management.
  • Lead GCS's engagement under certain business processes and partner across functional areas, particularly where there are touch-points with client onboarding teams and critical technology processes.
  • Ensure compliance with legal, regulatory and documentation risk controls and adhere to associated guidelines and procedures
  • Identify processes that can be improved around data capture, technology and documentation

Purpose of the role

To ensure that the activities of the business units in the Markets division are conducted in compliance with applicable laws, rules and regulations, and to help the bank manage legal risk associated with these activities. 

Accountabilities

  • Development and implementation of best practice legal strategies to manage compliance with applicable laws, rules and regulations.
  • Legal advice and support to the business units in the Markets division on matters arising from the relevant products/services provided by the Markets division  .
  • Subject matter support in the Legal department’s representation of the bank in legal proceedings related to the Markets business units such as litigation, arbitration, and regulatory investigations.
  • Creation and review of legal documents for the business units in the Markets division to ensure the bank’s compliance with applicable laws, rules and regulations. Maintaining and updating template legal documentation for the Markets division.
  • Legal research and analysis to stay up to date on changes in applicable laws, rules and regulations that may impact the activities of the bank's Markets business units   .
  • Developing and delivering training programmes to educate employees on legal and regulatory requirements related to the activities of the Markets business units   .
  • Pro-active identification, communication, and provision of legal advice on applicable laws, rules and regulations (LRRs). Keeping up to date with regards to changes to LRRs in the relevant coverage area. Ensuring that LRRs are effectively allocated to, and adequately reflected within, the relevant policies, standards and controls.

Director Expectations

  • Provide expert advice to senior functional management and committees to influence decisions made outside of own function, offering significant input to function wide strategic initiatives.
  • Manage, coordinate and enable resourcing, budgeting and policy creation for a significant sub-function.
  • Escalates breaches of policies / procedure appropriately.
  • Foster and guide compliance, ensure regulations are observed that relevant processes in place to facilitate adherence.
  • Focus on the external environment, regulators, or advocacy groups to both monitor and influence on behalf of Barclays, when appropriate.
  • Demonstrate extensive knowledge of how the function integrates with the business division / Group to achieve the overall business objectives.
  • Maintain broad and comprehensive knowledge of industry theories and practices within own discipline alongside up-to-date relevant sector / functional knowledge, and insight into external market developments / initiatives.
  • Use interpretative thinking and advanced analytical skills to solve problems and design solutions in often complex/ sensitive situations.
  • Exercise management authority to make significant decisions and certain strategic decisions or recommendations within own area.
  • Negotiate with and influence stakeholders at a senior level both internally and externally.
  • Act as principal contact point for key clients and counterparts in other functions/ businesses divisions.
  • Mandated as a spokesperson for the function and business division.
